TERMS AND CONDITIONS AND AGREEMENT OF SALE

1. APPLICATION OF THE TERMS AND CONDITIONS
1.1 The following General Terms and Conditions shall exclusively apply where the www.shop4eyes.com webshop is accessed for the case of sales of item(s) through this Agreement as well as for information.
1.2 No differing General Terms and Conditions will apply, without an express written affirmation by the www.shop4eyes.com webshop.
2. OFFER TO CUSTOMERS
2.1 www.shop4eyes.com webshop presents its offers to its customers visiting its electronic webshop, in a non-binding invitation to order and το buy the respective item(s). The customer is free to check all item(s) posted in there, and is exclusively responsible for the selection, the placement of an order and the purchase, according to the listed and available items there.
2.2 The binding order of the customer is concluded by pressing on the electronic page, the designated keys to order and to pay, and thus entering into a purchase Agreement. The Agreement will be concluded as soon as the payment is accomplished and the item(s) is/are delivered to the customer.
2.3 SHOP4EYES.com webshop is entitled to accept the order within the period necessary to clear the payment and to dispatch the item(s) to the customer.
3. SELECTION OF ITEMS, DISCOUNTS, ORDERING PROCESS AND CORRECTION OF INPUT ERRORS IN THE WEBSHOP
3.1 Visitors to the www.shop4eyes.com webshop can view the details of the posted items, by clicking on them. A customer may order one of the selected items, with a click on the “Add to cart” symbol. The customer then has the option to continue shopping and to place further items in the “shopping cart”. The item(s) already selected is/are displayed by clicking once on the “shopping cart” symbol. The number of items to be ordered by each customer is limited to the available quantities for sale; no decrease of this quantity takes place, unless a definite sale for this item has been confirmed.
3.2 The www.shop4eyes.com webshop can exercise its absolute discretion to make discounts to its items for sale and place them under the section “Offers” and under any other type of Special terms for their sale or shipping, including discounts to prices, and to use any other legitimate marketing means of commercial promotion. Items may exit the special terms for sale or shipping, again at the full discretion of the www.shop4eyes.com webshop.
3.3 Upon the completion by the customer of the wished lot of purchased items with all selected been put in the “shopping cart”, the customer is invited to click on the “Checkout” symbol. The customer will then be guided through the ordering process to register either as a “log-in” with an existing customer account, or he/she may continue without registration as a “guest” and provide his/her address of delivery. Before the binding order is placed, the information about the selected item(s) will be displayed with the unit price, the shipping costs, the total price, and the place of delivery, to check and confirm.
3.4 Input errors that arise during the ordering process can be corrected. Direct changes to the item(s) already in the shopping cart can be made, as well as to the shipping address.
4. ORDER CONFIRMATION, AGREEMENT, STORAGE OF THE ORDER TEXT
4.1 The confirmation of an order placed by a customer is made by two (2) electronic mails (emails) sent by www.shop4eyes.com webshop to the customer.
The first email is automatic by the system and notifies the customer that the order is recorded, and the payment was successfully concluded.
The second email is sent manually and confirms that the dispatch of the item(s) in the order has taken place to him/her; the tracking number of the shipment is entered in this email.
4.2 The confirmation of an order placed by a customer is made by two (2) electronic mails (emails) sent by www.shop4eyes.com webshop to the customer.
4.3 Customers are advised to save in their electronic means the data of their order, from the emails sent.
5. DELIVERY TIMES, DELAYS, PARTIAL DELIVERIES
5.1 Delivery is performed by sending the item(s) to an address specified by the customer. The customer will be obligated to ensure that delivery of the ordered item(s) to the stated address is possible during regular business and delivery hours. If additional delivery costs are incurred, as a result of incorrect delivery address data or of any fault of the customer, the customer is to refund these costs to SHOP4EYES.com webshop.
5.2 The item(s) will be delivered within the business days displayed with the shipment data in the respective electronic page of SHOP4EYES.com webshop, as it was selected by the customer and was confirmed in the second email to the customer. Excluding force majeure delays, the delivery time posted will be observed by the shipping agents of SHOP4EYES.com webshop, provided that the customer has correctly filled-in his/her address data in the provided form. If SHOP4EYES.com webshop shipping agents fail to observe the delivery deadlines excluding force majeure reasons, the customer is to allow an additional grace period of double business days for delivery, before he/she may be entitled to withdraw from the agreement after the grace period has expired without any result. In such a case the customer is entitled also of the full refund of its respective payment made to SHOP4EYES.com webshop.
5.3 SHOP4EYES.com webshop shall not be responsible for delivery delays as a result of force majeure, considered to be war, riot, checks and interventions of authorities, industrial actions, strikes or lock-out, as well as unavoidable operational or transport interruptions, such as power failures, fire, flooding, or the adverse effects of weather impairing transportation, any or all of these conditions occurring to SHOP4EYES.com webshop and its subcontractors implicated in the transportation and the delivery of the item(s). In such event, SHOP4EYES.com webshop shall be entitled to postpone the delivery by a reasonable period of at least thirty days (30), until the difficulty is alleviated or to withdraw from the agreement after that, without any compensation owed to the customer, other than the return of his/her respective payment already effected.
6. PRICES AND SHIPPING COSTS - CUSTOMS DUTIES
6.1 Fees for the item(s) delivery shall be charged to the customer according to location tariffs and shall be included in the total price for the item(s).
6.2 Fees for delivery shall be borne by the customer according to locations tariff, and shall be included in the total price for the item(s).
6.3 The customer shall be exclusively responsible for the payment of any and all customs duties, charges, and other levies in connection with his/her purchase.
7. PAYMENTS
7.1 Payment for the item(s) ordered from the www.shop4eyes.com webshop is executed solely and exclusively through recognized Payment Services Providers. All transactions carried out through our website are governed by International European laws, which regulate issues related to electronic commerce. All data transmission is made using Secure Socket Layer (SSL) encoding technology, protected by the highest online security systems and digital certification.
7.2 Bank Cards (credit of debit) payments are processed by Stripe Inc. www.stripe.com. If the customer is a holder of a PayPal www.paypal.com account, the payment can be made through the means made available there (Credit Cards, direct debit to PayPal accounts, and other payment means which are or will be offered by PayPal).
7.3 Payment through a bank card is maybe liable to bank and/or payment services provider procedures in accordance with the security standards asking the holder to complete a strong identification process defined by the banking institution from which the card has been issued.
7.4 Both Stripe and PayPal, in individual cases and according to their own rules and at their sole jurisdiction, which the customer fully and irrevocably accepts, reserve the right to not accept a payment. The transaction then is void and the customer/credit card holder is instantly notified according to the bank and/or payment service provider rules.
7.5 7.5 Any costs incurred as a result of chargebacks initiated by the customer shall be passed on to the customer, including any processing fees according to the Payment Services Providers policy, applicable at the time.
7.6 In any case, all www.shop4eyes.com webshop customers are strongly advised to read the respective Policy of the Payment Services Providers about their handling of payments, at https://stripe.com/docs/security, and www.paypal.com/va/webapps/mpp/pay-online
8. RIGHT OF CANCELLATION
8.1 If the customer is a natural person who enters into a legal transaction for a purpose that can neither be attributed to commercial nor to independent professional activity, then he/she is a consumer, and is entitled to the right of cancellation of this Agreement, without giving any reasons. It is stressed out that the item(s) returned due to the exercise of the right of cancellation, must be imperatively inside the original packaging, fully intact and without being opened.
8.2 The customer/consumer can exercise the right of cancellation, within fourteen (14) days as from the date on which the item(s) is/are into his/her physical possession. The customer/consumer in order to exercise the right of cancellation, must inform www.shop4eyes.com webshop on the cancellation, by means of the enclosed Contact Form in the www.shop4eyes.com webshop, including the Order ID and his will to exercise the right of cancellation. The use of the Contact Form is not mandatory, and any other legal means of notification can be used. The timely dispatch of the notice of cancellation, before the cancellation deadline, shall be deemed sufficient for compliance with the cancellation deadline.
8.3 Item(s) returned according to the right of cancellation must be shipped back to the www.shop4eyes.com webshop address, in their original and unopened packaging, within the time period of fourteen (14) days as from the date on which the item(s) is/are into his/her physical possession.
The deadline shall be deemed to have been met if the dispatch of the item(s) was before the expiry of the period of fourteen (14) days, proved by the shipment documents.
The unopened package may be returned by any suitable means to the official address of the www.shop4eyes.com webshop.
Customers returning any item(s) may use damage-resistant packaging that will include the original package, the latter to be left fully intact.
8.4 Customer rightfully returning any item(s) due to the right of cancellation, will bear in full the shipping costs of the return of the item(s).
8.5 In the event of the cancellation, all payments that are received from the customer for this agreement by the www.shop4eyes.com webshop, including the original delivery costs and with the exception of additional costs arising for any legal reason, will be repaid at the latest within fourteen days (14) days from the date on which the returned item(s) is/are delivered to the www.shop4eyes.com webshop.
The www.shop4eyes.com webshop may withhold the repayment, until the item(s) are received back, or until evidence that the item(s) is/are duly returned is supplied by the customer to the www.shop4eyes.com webshop.
9. RETURN OF DEFECTS
9.1 For the return of any item(s) as a result of defects, the customer is requested within a period of seven (7) days as from the delivery of the item(s) to the address specified by the customer, to make a notice of return by means of the enclosed Contact Form, including the Order ID, the code of return as described herein below and a description of the defect cause. The timely dispatch of the notice of return, before the return deadline, shall be deemed sufficient for compliance with the return deadline. Customers returning any item(s) as a result of defects will receive a confirmation email, code and instructions about the dispatching back to SHOP4EYES.com webshop.
9.2 Item(s) returned as a result of defects must be shipped back to the www.shop4eyes.com webshop address within the same time period of seven (7) days as from the date on which the item(s) is/are into his/her physical possession.
The deadline shall be deemed to have been met if the dispatch the item(s) was before the expiry of the period of seven (7) days proved by the shipment documents.
9.3 The item(s) must be re-packaged in the original packaging or in similar damage-resistant parcel and include the original, so that the original packaging of the item(s) is there and not damaged. All the item(s) parts and accompanying material must be included.
9.4 The www.shop4eyes.com webshop shall bear the costs of shipment of the item(s) returned as a result of defects up to the official address of the www.shop4eyes.com webshop, at the rate of the lowest cost, according to instructions to be given by it to the customer returning the item(s).
9.5 In the event of item(s) return as a result of defects, all payments that are received from the customer for this Agreement by the www.shop4eyes.com webshop, including the original delivery costs and with the exception of additional costs arising for any legal reason, will be repaid at the latest within fourteen days (14) days from the date on which the returned item(s) is/are delivered to the www.shop4eyes.com webshop.
The www.shop4eyes.com webshop may withhold the repayment, until the item(s) are received back or until evidence that the item(s) is/are duly returned is supplied by the customer to thewWww.shop4eyes.com webshop.
9.6 For this repayment, the same method of payment that was used for the initial payment transaction will be followed, unless otherwise is explicitly agreed. In no case any fees for this repayment will be charged.
9.7 Customers returning item(s) shall be liable for any diminished value of the item(s) during the period of retention, resulting from the handling the item(s) other than what is absolutely necessary to ascertain the nature, the characteristics and the functioning of the item(s).
10. LIABILITY
10.1 The www.shop4eyes.com webshop shall not be liable whatsoever in the case of injury to life, body and health as from the use of the item(s) sold.
10.2 In the case of delay or final impossibility of delivering the item(s) ordered, the www.shop4eyes.com webshop shall not be liable in the event of slight negligence.
10.3 The aforementioned limitations of liability shall also apply to corporate bodies, agents and subcontractors of the www.shop4eyes.com webshop.
11. LANGUAGE OF THE AGREEMENT, APPLICABLE LAW AND PLACE OF JURISDICTION
11.1 This agreement is entered in English language. All disputes arising from the legal relationship existing between the customer and the www.shop4eyes.com webshop shall be subject to the laws of the Republic of Bulgaria. The application of the UN Convention on Contracts for the International Sale of Goods/Items is excluded.
